1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity and Sowary, concerning your access to and use of the Sowary web application, mobile application, and related services. By accessing our services, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use.

2. Account Types and Access Controls

We provide two primary user roles, each subject to specific capabilities and rules:

• Event Organizers: Organizers are permitted to create events, manage upload parameters, generate QR access codes, and upload event photo galleries. Organizers must maintain valid credentials and are solely responsible for all images uploaded under their account.
• Attendees: Attendees can register for free to join events, browse public listings, view their match history, and save up to 50 starred photos to their persistent personal libraries.

Sowary provides a free tier for Attendees with a strict limit of **50 starred photos** per account.

• Starred photos are backed up to your private library and remain available even after an event has expired.
• If you reach the 50-star limit, you must unstar existing photos to free up space, or upgrade to a premium attendee subscription tier when available.
• Attempting to bypass the 50-star limit via multiple accounts, scripts, or other unauthorized methods is a violation of these terms and may result in immediate suspension.

5. Prohibited Activities

You agree not to engage in any of the following activities while using the services:

• Uploading malware, corrupted files, or executing automated scripts/crawlers against the platform APIs.
• Creating organizer accounts with false credentials or pretending to represent events you have no authority over.
• Impersonating another person by uploading their face/selfie to access their private matched photos.

6. Limitation of Liability and Disclaimers

Sowary's services are provided on an "as-is" and "as-available" basis. We do not guarantee that the face-matching AI will match 100% of photos due to environmental variations (e.g. angle, lighting, obstruction). We are not liable for any deletion, corruption, or loss of photos, including those in the persistent user libraries, resulting from system failures or event expirations. We recommend keeping local copies of your important photos.

7. Termination

We reserve the right, in our sole discretion and without notice or liability, to terminate or suspend your account or restrict access to the services if we suspect a violation of these terms, fraud, or abuse.
